Title IX Training Materials

Effective August 14, 2020, Title IX Regulations require that schools post training materials used to train the school’s Title IX personnel on their website. Training materials used to train Title IX personnel (such as, the Title IX Coordinator, any investigator, any decision-maker, and any person who facilitates an informal resolution) will be posted on this website and will be maintained for at least seven (7) years.

For additional transparency, materials may be made available upon request for those students, employees, the Department of Education, or members of the public seeking to further examine the training materials. THE STATEWIDE ASSOCIATION OF COMMUNITY COLLEGES (SWACC)

The Statewide Association of Community Colleges (SWACC) provides training for Title IX personnel through a collective with Grand River Solution. The Compton College Director of Diversity, Compliance, and Title IX has completed the training offered through its membership with SWACC. SWACC’s proprietary training material are housed on the SWACC Member Resources website.

TITLE IX TRAINING INFORMATION

Title IX Coordinator Annual Training

“From One Title IX Coordinator to Another: A Practical Approach to Navigating Beyond Compliance in the Post-Regulatory World”

Description: Title IX compliance continues to shift at federal and local levels and the role of the Title IX Coordinator is constantly evolving. This course will provide those serving in this critical role with an up-to-date overview of legal requirements and practical strategies for developing and implementing a Title IX program that is legally compliant and best serves campus communities. The two-part training will provide an overview of what is required of a coordinator, breaking it down into the three major functions of the role: (1) Prevention and Education; (2) Response; and (3) Compliance.

During this training, participants will gain insights and learn strategies for managing institutional compliance requirements, effective education of the campus community, and the coordination of the institutional response to reports. All attendees will receive sample communications and template forms including Title IX intake form, formal complaint, mandatory or discretionary dismissal notice, notice of investigation, and Title IX outreach letter. Participants may utilize and adopt these forms for their own school.

The agenda includes:

  • The Title IX timeline: An overview of the evolution of Title IX and other applicable laws and regulations;
  • The role of the Title IX Coordinator;
  • Building a foundation for success through collaborative partnerships, effective communications, and comprehensive policies and procedures;
  • Developing an all-encompassing plan for compliance;
  • Effective approaches and procedures for responding to reports;
  • Education and prevention strategies.

Title IX Hearing Panel

“Hearings in the New Era: The Hearing Panel” Part I

This training covers hearing skills in light of federal and local law and prepares attendees to conduct a fair, impartial, and compliant process. Attendees will receive a hearing checklist and resource for developing rules of decorum for live hearings.

An outline of the agenda includes:

  • The Regulations’ definition of sexual harassment;
  • The scope of the school’s “education program or activity” as defined by
  • the Regulations;
  • How to serve impartially, including by avoiding prejudgment of the facts at issue,
  • conflicts of interest, and bias;
  • Understanding issues of relevance and other evidentiary concerns;
  • An overview of the evidence exchange;
  • The purpose of a hearing;
  • The procedural requirements during the hearing;
  • Hearing preparation;
  • The roles of a hearing coordinator, hearing panel, and hearing chair;
  • The role of the advisor, and efficiently working with them;
  • Technical aspects of a hearing;
  • Decorum and managing the process;
  • Breaking down the policy into elements;
  • Developing questions for parties and witnesses;
  • Evidentiary considerations and evidence analysis.

Part II Mock Hearing

In this training, we will provide a mock investigative report to work through practical exercises. The extended training covers hearing skills in light of federal and local law and prepares attendees to conduct a fair, impartial, and compliant process. This experiential training is ideal for the Title IX Coordinator, hearing officer, decision-maker, hearing coordinator, hearing administrator, or any stakeholder needing to work through the intricacies of setting up and running a smooth hearing. Participants will apply their knowledge and practice skills during a mock hearing scenario. Participants will receive a hearing checklist and resource for developing rules of decorum for live hearings.

Year-end Title IX Review

“Title IX—A Year in Review”

During this session facilitators will take a look at the past year to highlight lessons learned and best practice on key aspects of Title IX Compliance. Attendees will learn about trends and important case law updates, updates from the U.S. Department of Education, and any significant state law changes. Participants will also look at the year ahead and hear tips for preparing for a successful year.

Title IX Investigator Annual Training

“Conducting Fair, Thorough, and Trauma-Informed Sexual Violence Investigations”

This training provides a detailed overview of best practices for investigating and adjudicating reports of sexual harassment and sexual and interpersonal violence. The training will address the practical application of trauma-informed principles when conducting fair, neutral, and thorough investigations. Participants will learn tools and strategies to assist them in effectively and efficiently executing their responsibilities as an investigator. All attendees will receive a model investigation report and a resource for collecting and maintaining evidence in Title IX investigations.

In keeping with the May 2020 Title IX Regulations, the outline of the agenda includes:

  • Practical application of the regulatory requirements;
  • Fair and impartial application of trauma-informed practices;
  • Developing an investigation strategy;
  • Conducting investigation interviews;
  • Developing appropriate lines of questioning;
  • Evidence collection;
  • Evidence assessment;
  • Report writing—creating an investigation report that fairly summarizes relevant evidence.

Investigative Report Writing Workshop

A two-part report writing workshop to develop and refine skills related to writing investigation reports pursuant with federal law and best practice. The outline of the agenda is as follows:

Part 1: During this session the facilitator will focus on report writing mechanics, structure of a report, organization of the evidence, and writing for clarity, accuracy, and neutrality in a concise manner. Attendees will also learn how to appropriately represent procedural steps taken where such steps are relevant to the decision maker’s final determination. Following this session, the participants will receive mock evidence to utilize during the following session.

Part 2: During this session, attendees will assemble the investigative record and create a comprehensive outline of the investigation report. At the conclusion of the session, the participants will receive a model investigation report based on the mock evidence.

Asynchronous Training

Title IX Informal Resolution (Asynchronous)

“Informal Resolution for Institutions of Higher Education”

This training covers the requirements under the May 2020 Title IX Regulations for informal resolution. Participants will learn about informal resolution within the context of the educational environment and the role pursuant to the May 2020 Title IX Regulations. Attendees will hear how to apply techniques and strategies to Title IX and sexual misconduct cases.

The agenda includes:

  • Informal resolution, mediation, and alternative dispute options and requirements;
  • Impartiality, avoiding bias, conflict of interest, and prejudgment of fact;
  • Title IX’s definition of sexual harassment;
  • Scope of the school’s education program or activity;
  • How to work with parties to identify needs, wants, and areas of compromise;
  • Considerations for reaching a mutually beneficial decision;
  • Strategies for implementation;
  • Documenting agreements.
  • Title IX Advisor Training (Asynchronous)

    “Being an Effective Title IX Advisor: From Investigation to Hearing”

    Advisors play a critical role throughout the investigation and adjudication of Title IX matters. This training provides an overview of the role of a Title IX advisor as set forth in the May 2020 Final Title IX Regulations and how to balance those requirements with individual institutional requirements for advisor participation.

    Attendees will learn about the advisor’s role throughout each stage of the Title IX resolution process, from the filing of the formal complaint through the investigation, hearing, and appeal. Facilitators will address how to provide appropriate support during the investigation, including evidence identification, and submission of responses to the evidence and the investigation report, and how to conduct questioning at hearings. Our facilitators will lead attendees through a practical application exercise designed to provide advisors with the necessary skills and confidence to be an effective advisor.

    The agenda includes:

  • Working with advisees;
  • Pre-hearing preparation tasks, including issue identification and preparing questions;
  • Different question types and when to employ them;
  • Considerations when conducting questioning of parties and witnesses;
  • Maintaining focus and keeping on track;
  • Knowledge check–a practical application of the skills.
